Responsibilities

If you’re a landlord, you are required by law to ensure your property meets several electrical safety standards.

 

Electrical Inspections and Testing

Mandatory Inspections

Under the 2020 regulations, landlords must have their property’s electrical installations inspected and tested by a qualified person at least every five years.

Scope of Application

This requirement covers all private tenancies, including Houses in Multiple Occupation (HMOs), where the property is the main or only residence of the tenant and rent is paid.

 

Compliance and Documentation

Obtaining an EICR

After each inspection and test, landlords are required to obtain an Electrical Installation Condition Report (EICR).

Providing the Report

This report must be given to the current tenant within 28 days of the inspection, to new tenants before they move in, and to prospective tenants within 28 days of request.

Local Authority Requests

If requested, landlords must supply a copy of the EICR to the local authority within 7 days.

Remedial Work

Addressing Identified Issues

Landlords must complete any urgent repair or investigative work identified in the EICR (coded as C1, C2, or FI) within 28 days or a shorter period as specified in the report.

Confirmation of Work

Once completed, landlords must provide written confirmation of the remedial works to both the tenant and the local authority within 28 days.

 

Electrical Appliances

Beyond the 2020 Regulations

The regulations focus on fixed electrical installations and do not cover electrical appliances provided by the landlord.

Recommended Practice

It’s advised that landlords conduct Portable Appliance Testing (PAT) on any electrical appliance provided and share the results with tenants.

 

Smoke and Carbon Monoxide Alarms

Regulatory Requirements

Landlords must comply with the Smoke and Carbon Monoxide Alarm (England) Regulations, requiring smoke alarms on every storey and carbon monoxide alarms in rooms with solid fuel-burning appliances.

 

Access and Escape Routes

Safety in Common Areas

Landlords should ensure that common areas of the building, which are crucial for fire escape routes, have adequate lighting, emergency lighting, and fire alarm coverage.
